Cherokee Events Non-Profit reserves the right to review all applications and make vendor decisions based on need and diversity of products sold at the festival. No independent vendor will be granted exclusivity at the festival.

VENDOR rules

Thank you for your interest in participating as a vendor at the Cherokee Street Cinco de Mayo Festival. Cherokee Events reserves the right to review all applications and make vendor decisions to ensure the event is a success. Please read the following vendor rules carefully. 

Application, Insurance, and Permits

1.  Vendor applications must be submitted by the deadline. Payment is due at the time of application submission. Failure to do so may result in forfeiture of participation in the festival. Cherokee Events reserves the right to accept or reject applications.

2.  Vendors must apply for all licenses and permits with the City of St. Louis. Each vendor is responsible for obtaining necessary permits and submitting them to Cherokee Events by the specified deadline.     

3.  A certificate of liability insurance is required naming Cherokee Events, its Board of Directors, agents and assigns, and the City of St. Louis, Missouri as “additional insured” for the time of the event.  Insurance must be in the amount of $1,000,000 deemed acceptable to Cherokee Events in accordance with vendor’s activity. Vendors for whom certificates of insurance are not received will not be assigned a booth. 

4. Only items approved at the time of permit issuance can be sold.  Cherokee Events reserves the right to reject any product(s) the vendor may wish to sell.   

5. All vendors are given an opportunity within the application to indicate their preferred location for vending. Cherokee Street Events will choose all final booth locations based on safety, traffic, logistics, and neighborhood concerns. All decisions by Cherokee Events are final. 

6. Food and Liquor Vendors are required to attend a vendor meeting on Tuesday, April 16th at 5pm at The Golden Record, 2720 Cherokee Street.

Check-In/Setup/Breakdown

1. Vendor Check-In 7am-9am - All vendors are required to check in at the designated Entrance/Location and pick up a vendor information packet. If you have a business on Cherokee street, you will need to walk down and check in before you begin setting up. 

2. All booths are required to be set up and ready for operation by 10:00am. Any vendor caught selling beyond festival approved time windows will have their permit pulled and will be fined $250.

3. Parking and access to the event area will be tightly restricted. All vehicles must be off the premises by 9:30 AM. Vendors are allowed to hand cart additional supplies throughout the day. Vendor’s vehicles will not be allowed back on the premises until after 8:00 PM and/or when the street is cleared by the SLMPD. If any vehicles are found parked within festival boundaries between 9:30 A.M. to 8:00 PM, they will be towed.

4. Vendors with sound/music/performances using amplified music will need to be pre-approved and will have a stoppage time of 7:00 pm. Sound/music/performances should be listed in the application within the description.

5. Tents, lighting, electricity, propane, water source, etc is the responsibility of the vendor. All Equipment, supplies, booth material, and selling activities must be kept within your allocated space. If using propane, vendors will need to obtain a permit through the Saint Louis Fire Department.

6. Last call for food and alcohol vendors will be 6:30 pm with a sales stoppage at 7:00 pm.

7. Any vendor dealing with grease or oil is required to provide receptacles into which you can safely secure your grease and take it with you to your place of business or an approved disposal location. Leaving or disposing of your grease or oil in any other manner will result in a $500 fine. 

8. Vendors are responsible for trash pick-up and removal from their assigned location and the 10 feet surrounding the area.  Residential dumpsters are not available for commercial use.  Cherokee Events will provide dumpsters and recycling stations specifically for this event and will be clearly marked. Remember, you are a guest in the neighborhood. A fine of $250 will be assessed if your booth is not clean at the end of the event.

Sales/Operations

1. The laws of the State of Missouri and the City of St. Louis will apply to all vendors.  Failure to comply with these laws will cause your booth to be closed with no refunds.

2. Cherokee Events has contracted sponsorship agreements that provide for the preferred sales of specific product lines by vendors choosing to sell in that category.  All vendors are required to adhere to the sponsorship agreements.  All sponsorship agreements will be announced in April of 2024.  Failure to adhere will cause immediate closure, removal of the booth, and forfeiture of payment.

3. Cherokee Events presents this event for the general public and reserves all rights as the sole producer of the event.

4. For safety reasons, all vendors are responsible for keeping the sidewalk around their booth clear. This is VERY important and will be strictly enforced by the Festival AND STLFD.

5. Those working in a booth must be at least 18 years of age. Alcohol servers must be at least 21 years of age.

6. No toy guns, smoke bombs, fireworks, or snap poppers/snappers/bang pops/bang snaps are allowed to be sold at the festival.  

7. Bottles, cans, coolers and backpacks will not be allowed in the event area. Vendors must pour all drinks into disposable cups.

APPLICATION AGREEMENT 

The Cherokee Street Cinco de Mayo Festival is a rain or shine event. Attendance at this event is weather related. Cherokee Events, its Board of Directors, or other authorized representatives make no guarantees, representations, or compensation regarding attendance.

Applicant understands and agrees that Cherokee Events, its Board of Directors, or other authorized representatives are not to be held liable for weather conditions, acts of God, acts of terrorism, governmental intervention, or any other incident that may prevent and/or interrupt the event causing a loss of business.
